Appropriate Assessment Consultation Submission Draft Suffolk Minerals & Waste Local Plan
The requirement to carry out an Appropriate Assessment of the Plan arises from fresh case law from the Court of Justice of the European Union. The so called “People over Wind” judgement ruled that non-standard environmental mitigation cannot be taken into account when determining if an Appropriate Assessment is required. An Appropriate Assessment has now been produced. Legal advice is that full public consultation for a six week period should be carried out upon the Appropriate Assessment before the Plan itself can be submitted to the Planning Inspectorate. Alternatively, hard copies of the Appropriate Assessment may be provided upon request.
The documents can also be viewed at the main Suffolk County Council offices at Endeavour House, 8 Russell Road, Ipswich, IP1 2BX.
The Consultation begins at 5pm on 05 November 2018. Please complete and submit the online for, downloadable form or email, or write to Suffolk County Council at the email or postal address provided. In all cases the correspondence must be received by 5pm on the 17 December 2018, or the views expressed will not be able to be taken into account. Only representations concerning the HRA/Appropriate Assessment will be accepted.
